MACRAES.— May 20.

Resident Magistrate's Court. ; (Before H. W. Robinson, EsqV, R.IL) Drunk and Disorderly.—Ellen Collins, on bail, for this offence did.not' appear. 33ail forfeifed. • Cattle Rescue.—Robert Boyd appeared, to answer an information for rescuing a bullock from the custody of Thomas Stanley. This case had been heard at the last •sitting of the Court in the absence of the defendant, but a re-hearing had been granted. Mr. Eowlait now'appeared to the case. It appeared that on the '24 th March Stanley, who acted as ranger ■of the Deep Dell run, was about driving some cattle to pound. Defendant, who was on the opposite (Hyde) side of the Taieri river, hastened across, and began to drive away one while bullock, his property. Stanley endeavored to prevent him, but Boyd succeeded in getting the beast away. The case for the defence was that, at the lime Boyd began to drive ■the bullock, it was not actually in Stanlev's custody. The evidence was somewhat conflicting, but the Bench held that "the bullock was to be regarded as being constructively in Stanley's possession. /Stanley said he did not wish to push for a ieavy penalty; and the Court, taking this into consideration, imposed the mitigated fine of 10s., with costs of Court 15s. Bd., and 60s. expenses. •An Geweyv. Hartstonge.--Debt, £l3 "3a. 6d. In this case the summons had •not been served, as it appeared the defendant resided in Dunedin, there had been no affidavit to give jurisdiction. The plaintiff now appeared, and made the usual affidavit that the cause of action had arisen within the jurisdiction of the Court. The Magistrate lixed the hearing for June 17th. Eggers v. ■Gr. Cockcrell v. Andrew Christensen.— 'Complaint, praying for the cancellation of a residence area certificate. Mr. Rowlall for complainant. Defendant in formed the Court that the residence area in question Tvas included in a section of land, of which he had obtained the grant on deferred payment. Mr. Rowlatt said lie was .aware of this, but that defendant had not obtained the grant until after the present complaint was laid. His client had now aio object in pressing the complaint, and woula withdraw it if defendant would pay the expenses incurred. The Court recommended that the expenses should be divided between the parlies, which was accordingly done, and the complaint withdrawn.

E. Griffon v. George Cockcrell.—Mr. Rowlatt ft>r defendant. This was a similar complaint to the preceding case, but the complainant bad failed in his complaint to describe the position of the land, or to identify it by quoting the number and date of the certificate under which it was held. Mr. Rowlatt submitted that the case must be dismissed for uncertainty. There was really nothing definite for his client to answer. The complainant asked that the hearing might be adjourned, to enable him to supply the necessary particulars. Adjourned accordingly (by consent), complainant .paying adjournment fee, and 21s. professional expenses for defendant. Grants. —Ah Lem • and dam and tailrace.
