Fbiday, Novembeb 13. (Before H. W. Robinson, Esq., R M.) •J. Bremner and others (managers of Naseby Cemetery) v. John Creighton. —Claim for £lO damages resulting from defendant having constructed a water race across the Cemetery Reserve, very near, to the wall of the portion fenced. Mr. Kowlatt for plaintiffs. Evidence was adducedto show that the contractor for making a ditch outside the cemetery wall had been unable to complete his work in consequence of Mr. Creighton's race being in the way, and the work could not now be finished except at an enhanced price. For the defence it was contended ihat certain of the managers had given a •general right to the defendant, and other miners, to occupy, for mining purposes, •all that portion of the reserve not actually included in the fence. Mr. Bowlatt submitted that it was not competent for the managers to give such a right—the reserve was a public reserve for a specific purpose. Judgment reserved. George Clarke (Town Clerk) v. G. F. Newmarch.—Claim £3 15s. for rates upon Masonic Hall. The sitting Magistrate said that he should be unable to hear this case, as he was interested to the extent Of holding some shares in the Company. Hearing adjourned sini die. To be taken before tW9 Justices not interested. ♦— Monday, Novembeh 16.

John Mack ay was brought up in cus;tody, charged with maliciously destroying a gate, the property of "W. and J. Sanders, valued at £3. Mr. Rowlatt, for defendant, said he jpleaded guilty. He had done the mischief partly in ignorance, and partly, as be admitted, under the influence of liquor. He was a carrier, and, finding the gate closed across the road, ,had destoyed it. He was sorry for what he had done, and threw himself upon the mercy of the Court. Finod £2, and Is. 6d. costs, in addition to paying £3, •the value of the property.
