September lira. (Before EL. W. clobinson, Esq , Warden.) M'Grrath v. Ah See aud another.—.Complaint for interference with a tail race, and washing out gold therefrom. £5 damages claimed. Mr. Rowlatt for the defendants. It appears, that the defendants, washing to work .-onifi ground in Koaeh's gully, had cleaned out an apparently abandoned tail race for the purpose. This tail race was claimed by the complainant, and said to con : tain a quantity of wash dirt. The Warden visited the ground, and, on returning, a judgment was given, by consent, for £2 10a. and costs, defendants to be allowed 21 days for washing up. . .
