ST. BATHANS.—JuIy 8.
Wabden's Coust. (Before H. W. Robinson, Esq., Warden.) Wade v. Johnstone.—This was a complaint that the defendant, having a right to -water from the Idaburn, had intercepted, by his race, the water of four gullies on the course of it, which ifhe eompiainant claimed as feeders for his water rights. Damages were laid at the nominal amount of £l. JxTr Johnstone, the defendant, was willing to give up all ckim. to some of the tribufa-cies in question, but did not feel ; justified in abandoning them all. The case was adjourned till nest Court, with the object of allowing the defendant to obtain certain documents in connection with the original grant of his water race. Application to shift road.—Scandinavian Water Eace Company, Registered, made application to be allowed to shift a portion of the road from St. Bathans to Becks, where it passed through a special claim held by them. The company undertook to provide road of same width, to make culverts where necessary, and to provide approaches from the new road for the occupation of residence the line of alteration. Granted—provided that an equally good road be made befox*e the old one is interfered with. The other business consisted of pay-' ment of rents and similar matters, which need not be specified,* but which occupied the Warden until after dark.
