COURT OF PETTY SESSIONS.
Monday, April 28th:. (Before H. W. Robinson, Esq., R.M., and W. G-rumitt, Esq., J.P.) Bailey v. the Corporation of Naseby Claim of £lO 10s., amount of account for services rendered in the capacity of acting Town Clerk. Paid into Court. With reference tg this case, the Clerk to the Bench stated that notices had been lodged by Mr. E. T. Greorge, both in the Resident Magistrate's and Petty Sessions Courts, requiring the Clerk not to part with the money until the further order of the Court. A letter was also read, signed by all the Councillors of Naseby, stating that the money in dispute was the property of the Council, who claimed it, requesting that an order be given for payment to the Town Clerk. It appeared that Mr. Greorge had an unsatisfied warrant of distress against the plaintiff in the above cause, and wished to obtain the amount coming to the plaintiff in part satisfaction of the warrant. The Bench decided that the Petty Sessions Court had no power to make a,n order in the matter, and that, in any case, the retention of money is discretional with the Bench, and, in face of the protest of the Councillors, the money in question would certainly not be impounded. The amount of the judgment was accordingly paid to the plaintiff.
