RESIDENT MAGISTRATE'S COURT

Tuesday, April 29th. (Before H. W. Robinson, Esq., R.M.) George v. Bailey.—Claim £4. Tlie summons in this matter having been only served tlie day previous, and tlie defendant objecting to the hearing, tlie case was accordingly struck out. Same v. Same. —Fraud summons for £3 Is. 6d., being the balance of a judgment obtained against tlie defendant, iu November, 1871. The defendant pleaded that the judgment had been satisfied, aud produced two receipts in corroboration, which lie swore were given in satisfaction of the present claim. The receipts did not purport to have been given iii respect of the judgment now sued for, aud the plaintiff deemed that such was the case, but stated that the defendant had received credit for the amount of the receipts, on a previous unsatisfied judgment. The plea was therefore not established, and the defendant was ultimately ordered to pay half the amount on or before the 10th May, and the balance on or before the 24Lh. Mr. Howlatt appeared for the plaintiff.
