WARDEN'S COURT.
Monday, March 10th. (Before H. W. .Robins m, Esq., Warden), (xufne and Others v. White aud Others.— This was a complaint for encroachment upon a claim situate at CLrks Diggings which has already in one way or another been before the Court five times. It appeared from the evidence i.hat the defendants had marked out the ground in dispute on the 20th."February last,, and the plaintiffs treating the marking out as illegal, marked it out for themselves 'on the 21st February. Both parties claimed; ; the ground, and the defendants had been | working it, hence the alleged encroachment, The Warden sustained the complaint on its. merits, but reserved judgment on two questions of law in the form of especial cases for the opinion of the District Court. The casewill probably be argued to-day. Mr. J ertslet for complainants, Mr. Bowlatt for defends n(s.
