"Warden's Court. (Before H. W. Robinson Esq., Warden.) Stevens and''others v. Nicholas and others.—Complaint tor forfeiture of tail race near Shepherd's hut. .Mr. Hertslet for plaintiffs. Mr. Bailey for defendants. Mr. Bailey, on behalf of the defendants, said that he was instructed to plead that the tail race in question was not their property; he, therefore/asked that the case be dismissed, and, as his clients had been wrongly brought to Court, he claimed costs. Mr. Hertslet, for the other side, submitted that defendants would not have been brought to Court if they had not represented" themselves as the owners of the property. The Warden took evidence on this matter, and finally decided to dismiss the case, but refused to allow costs. Special Claim.—The application of Mchoias and Company, at Shepherd's hut, was withdrawn. Grants.—J. Roberts, extended claim; A. Roberts, extended claim and tail race; Booth and another, tunnell; A. Esson, tail race; J. Penkefch, extended claim; W. Edmonds, extended claim. Withdrawn.—A Esson, tail race. I
