Warden's Court.

Harvey v. Jenkins and Noah.—This was a complaint that the defendants had trespassed upon, the elai:n held by complainants, in .partnership with W. O. Ball and others, and had removed goldbearing quartz, doing damage to the value of £2OO. Mr. Hodgkins appeared for the complainant, and Mr. Stout for the defendants. The. case was heardbelbre the- Warden and as-
sesspra: 1 - u Tt" appeared evidence that the defendants had had,. permission of two members of the complainants' company (Hugh Sutherland and Peter Petersen), and the assessors,' under the direction of the "Warden, found a verdict for the defendants. Complaint was dismissed, with' costs. £3 10\s., expenses of two. witnesses, 205., and professionalcosrs, £3 3s. Harvey v. Donnelly, Harvey v. Black, and dLarvey v. Malouey were all cases of exactly similar character, and the complaints were withdrawn by Mr. Hodiikins —complainants paying costs and expenses.
