M'Aulay and party v. O'Connell and party. —This v* as an appeal irom a decision made by Mr. Warden Robinson at Hyde, on the 27th of May last, when a judgment was given against the present appellants for the sum of £45, for interference with respondents' mining lease area and the loss of gold resulting therefrom. This judgment it was the object of the present appeal to reverse, in consequence, however, of some informality (the Warden not having been served with a notice of appeal, as provided for in the Goldfields Act), his Honor decided that, as the service of such notice was imperative under the Act, it was not competent for him to let the ease proceed, and dismissed the appeal without costs. Mr. Hertslet for appellants, Mr. Bailey for respondents.
