DOUGHDAS V. ROWLATT, (To the Editor of the Mount Ida Chronicle.) Sib,—l w&s plaintiff in an action the other day, when I sued the defendant Mr. Rowlatt for the sum of £l3s. 9d, balance of account due him for bread supplied to that gentleman. Mr. Rowlatt swore to his having paid me the sum claimed opposite the. Royal Hotel, but could produce neither receipt or witness to the payment. lon the other hand swore thai'l' had not received the money alleged to have been paid. The case was struk out and I lost my money. I want to know why my oath was not as good as M". Rowhitt? t value my character and reputation just as much as Mr~ Rowlatt can do his, and I feel that the judgment given on the occasion referred to was not only unjust .but might tend to injure me in the eyes of those whose opinion I respect. It is. the first occasion in which I have heard of a judgment of the kind being given where word was against word—-oath against oath—and onwhich no receipt was or could be produced. Am I, shv.to look upon this as an exceptional case, or only as another instance of G-oldfields justice? If judgments such as these are permitted, whh no power of appeal as I hear is the case, the storekeepers may as well keep no books, as'the word of the debtor without a receipr, appears to be in the eyes of some Magistrates of more value- than the word of the ere- : ditor, day book, ledger, and all.
