DISTRICT COURT.— March 15.

(Before His Honor Wilson Gray.)

'.. In this Court the appeal cases— M'Grath v. Gogarty and Greer and Gogarty.and Greer v. M'Grath—were heard. Both cases had reference to jurisdiction. In the first case the ques tion was whether an appeal lay from the decision .of the Warden in cases of application for mining privileges in which objection had' been made and sustained. The Court ruled that the act on the part of the Warden, being a ministerial, and not a judicial, one, fnb appeal could lie —the Court having l-po jurisdiction. Lithe second case" the question was wherhei the Warden had upon good grounds shown the power to cancel a water license which had been obtained by misrepresentation. When this case was tried before the "Warden his Worship ruled that there was no power given under the Act under which he could exercise such a power, though he undoubtedly had the power to cancel a certificate The real matter at issue, therefore, was whether the terms " license " and " certificate " were synonymous or not. His Honor reserved judgment. Saturday, March 16. In 'Bankruptcy.—A final discharge was granted to Frederick Tootell. Mr. Eowlatt appeared for the bankrupt and Mr. Wilson for the trustee.
