WARDEN'S COURT.—Nov. 10.
(Before 11. W. Robinson, Esq., Warden.) Police v. six Chinamen.—The complaint in this case was that they (the Chinamen) had been, and we re still, mining at Clarks Diggings without being in possession of the necessary miners' rights. Ignorance of the necessity of holding miners' rights was pleaded, and in the case of the new arrivals was admitted in three cases as an extenuating circumstance, and a mitigated penalty of 10s. and costs, with the alternative of three days' imprisonment with hard labor, was inflicted. In the other cases, it having been established that the defendants had been for years past mining in Victoria, the Court held the excuse to be insufficient, as. they must have known better, and inflicted a penalty of £5 and costs, with the alternative of six days' imprisonment.
