WARDEN'S COURT.—Sept. 18.

(Before H. W. Robinson, Esq., Warden, and Assessors.) Farmer v. Momingtou and others. —This was a complaint that the defeudiuts had, by mining too close to the registered dam of the Mount Ida Water Race Company, under lease to complainant, situate on Surface Hill, rendered the same insecure, and the sum cf £4O was now sought to be recovered as damages. The Warden and assessors having visited the ground, verdict of £lO was given for plaintiff, costs divided, each party to pay their own witnesses. Mr. Hertslet for plaintiff, Air. Bailey for defendants. Tuesday, Septembeb 19th. Several applications for water races at Clarks diggings were disposed of, and the hearing of others, against which objections had been lodged, was fixed for the 26th inst.
