WARDEN'S COURT.
Thubsdat, 30th Maech. (Before H. W. Robinson, Esq., Warden.) Erater and Others v. Gogartv and —The complaint in this case as that the defendants had unlawfully v iaged complainants' water race, sading from the falls of the Little yeburn, by having, between the first
day of February and the 25th March, 1871, discharged tailings and tail water into the Little Kyeburn above the head of the said race, whereby a portion of the said tailings accumulated in the race, and haveblocked up its head, damaging complainants by loss of time and water to the extent of twenty pounds sterling, and praying that defendants be adjudged to pay the said sum of £2O for such damage. The Court adjourned at 1 o'clock till 2,30, m order to give the parties eoneemed of eominjr to art amicawe settlement?. Xtie Gourc TiavTng reassembled, it was notified that all attempts at a satisfactory settlement had proved unsuccessful. The case was then proceeded with, the defendants, each in his turn, pleading not liable for damage (if any). The case occupied the entire afternoon. Evidence too long for publication. Verdict, £lO, with costs of Court 355., 30s. for three witnesses, and 245. mileage.
