The case was postponed, to beheard at Macraes on next Court day, Thursday, 4th .Dec. Is the Warden's Court on Monday, 21st instant, the case of M'-Namara v; Creighton was heard. This was an action to make, an order to alter the course of a tail race for which the defendant, had obtained a certificate by false representation—having pointed out one line of race-while he had, after obtaining the certificate, taken another, whereby the tail race of plaintiff was injured. The Warden and parties interested visited the ground in Enterprise Gully, when the following compromise was arrived at and endorsed upon defendant'a certificate. Judgment by. consent -as
