Warden's Court.—July 5. (Before H. "W. Robinson, Esq., Warden.) W. jB. Leader v, A. M'Leod.—Complaint- that the defendant has abandoned his water race and dani at Blackstone Hill. Plain tiff prayed that they lie adjudged.forfeit, and granted to hitn. The defendant .did not appear, and as it 'was shown in -evidence that both rat e and dam had been abandoned for twelve or eighteen months, judgment was given .for plaintiff in 'accordance with his complaint.
