WARDEN'S COURT.—March 3.

(Before H. W. Robinson, Esq., Warden.) James Harper v. Hugh Donnelly.— This was an action brought by complainant for cancellation -of a transfer made by James Donnelly to the defendant, and which the complainant alleged was illegal, and of non-effect as against the sale by the Bailiff of the Resident Magistrate's Court, under a warrant of distress, of the right, title, and interest (if any) of James Donnelly in and to a certain water race at the Kyeburn, and at which sale the complainant became the purchaser. Case adjourned to Saturday, the 5th inst. The application of Mr. John Bathgate, pn behalf of the Nil Desperandum Company, for a mining lease of sixteen and a-half acres at Mullocky Gully, near Hindon, was heard before the Warden. Mr. A, Bathgate appeared for the applicants. There was no appearance of Mr. Fuller, the objector. Mr. Bathgate made a statement of the facts under which the application was made, and Mr. Graves also gave evidence on oath of support of the application, The Warden decided to recommend, the granting of a lease as applied for. ■■•
