CLAIM FOR MILK BONUS.
UPHELD BY JUDGE. New Plymouth, July 18. In the Supreme Court, before Mr. Justice Ostler, William Johnson sued the Ettham Co-operative Dairy Company, claiming £lOl 16/7, balance due for milk supplied. The company altered its articles to provide that if a member did not. supply milk for the whole season he should get no bonus.. From November 4, 1924, to February 28, 1925, the plaintiff -supplied only half his milk. He claimed on the grounds that the change in the articles was ultra vires. His Honour held that such a change could be made, but it must 'lie brought to the notice of suppliers, and plaintiff’s statement that he was ignorant of the decision must be accepted. Judgment was given for the plaintiff. d
