WRIT OF HABEAS CORPUS.
Auckland, December 18. , Mr., Justice Blair has granted a writ of habeas corpus release from prison Francis Cairns, of Aria, a farmer. Cairns had been committed to six weeks’ imprisonment by a Magistrate for non-payment of the costs of an appeal heard in the Supreme Court, which arose out of an action by ICairns against a neighbour, whom he charged with being the father of his daughter’s child. That application was dismissed, also Cairns’s appeal. The neighbour then sued 'Cairns for costs, and had him committed to gaol. His Honour, in granting a writ for habeas corpus, said it was a matter for substantial costs. He fixed costs for £ls 15/-, against the neighbour. The contention of Cairns’s counsel was that the Magistrate had no jurisdiction to order his committal for non-payment of costs hr the original proceedings.
