FOR PICKING THE 'WIEN'NERS. Auckland, Last Night. In the Police Court to-day the Sun Newspaper Limited was fined £5 on each of three charges brought under the Gaming Act as a result of racing competitions conducted last year. The charges wpre of establishing a lottery; receiving money in consideration to pay money on the contingency of a horse race; and, lastly, with receiving money as a consideration for a promise to pay £IOOO on the result of the New Zealand Cup and the New Zealand Trotting Cup. In a reserved judgment, Mr. M‘Kean, S.M., said he was not prepared to deny that the possession of some knowledge of the form of horses might not be an advantage to competitors. However the accurate placing of horses at a time when it was not known whether soma of the horses would be scratched was a matter in which the element of chance predominated. It 'had been decided that a game in which there was a mixture of skill and chance could be unlawful. The defendants, therefore, he said, would be convicted and fined £5 on each of the three charges.
