S.M. COURT.

MONTHLY SITTING. The usual monthly sitting of the local S.M. Court was held in the Oourthou'se yesterday, before Mr. J. L. Stout, S.M. ILLEGALLY ON LICENSED PREMISES. A. Harper, charged, with being illegally on the licensed premises of the Post Office Hotel on 17th April, was convicted and fined £2, with costs' 10s. breach op Shops act. J. P. Desmond was charged by the police with keeping his shop open on Sunday, April 17th, for the purpose of selling goods. Mr. M. B. Bergin appeared for defendant, who pleaded guilty. Constable Owen said that on the day in question a car pulled up outside the shop in Main street and one of the passengers, a lady, purchased ice creams which were consumed in the car outside the shop. Constable Ryan interviewed the person in charge of the shop who admitted selling the refreshments, but who thought that it would be all right' as long as. they were consumed in the ear outside. Mr. Bergin said the case was a border-line one. There had been no attempt,to evade the law or mislead the police. The shop was situated right opposite the police station. Had the purchasers, consumed the’ refreshments on the door step of the premises they would have been within the law, but by walking across the footpath and consuming them in the car they committed a breach of the law. Defendant was convicted and fined 10s with costs 10s. WANDERING STOCK. Mr. W. Berry, Traffic Inspector for the Manawatu County Council, proceeded against A. Groome, of Himatangi, for allowing cows to wander on the county roads. Since, the action had been laid, said the inspector, twenty charges' could have been laid as the cows had been on (jhe road practically night and Defendant was convicted and fined £1 with costs £1 ss. CIVIL CASES. Judgment was given for plaintiff in the following undefended civil cases: — , . H. Osborne v. K. Maston, claim £23 4s 9d, costs £1 18s; W. H. Mawlienney v. S.
