CLAIMS FOR MEALS

BUTCHER SUED BY HOTELKEEPER, Auckland, March 15. It is evidently unwise for a butcher to accept a cup of tea at a private hotel when he delivers his daily meat, as was shown this morning at the Magistrate’s Court when David L. O’Donnell, proprietor of a private hotel, sued S. Reid, butcher, claiming a sum of £7 165., being the amount alleged to be due for meals supplied to defendant between the months of July and Dcidember, 1926. When the case was called, Mr. Simpson (for plaintiff) intimated that he wished to have it struck out.

Air. Sullivan, defendant’s counsel, applied for costs, stating that the claim was a most impudent one. Reid, he said, served the private hotel, of which plaintiff was proprietor. After Reid had delivered his meat the maid would sometimes offer him a cup of tea. Ultimately O’Donnell heard of this and wrote to defendant for the price of 100 meals at 1/0 per meal (Laughter). “It is an impudent claim, and defendant is here, and claims expenses. He feels outraged over the matter,” said Air. Sitllivan. Air. E. C. Cutten, S.AI.: Why outraged, Mr. Sullivan? Air. Sullivan: Well, he accepted cups of tea more to please than to be pleased. Tim Magistrate allowed costs and expenses to defendant.
