ALLEGED NEGLIGENT DRIVING.
BAILEY NOT GUILTY
The re-trial of Herbert Michael Bailey on the charge of negligent driving of a motor cycle on Rangitikei line on March 22, and thereby causing the death of Maurice Stewart, was heal’d at the Supreme Court at Palmerston on Thursday morning before His Honour Mr. Justice Reed and a jury of twelve. At the last session of the Supremo Court, the jury was unable to agree, and, consequently, a new trial was ordered.
After hearing evidence for the prosecution, Mr. Cooper, addressing His Honour, submitted that I here was no evidence of negligence on the part of accused and that, consequently, there was no ease to go to the jury. His Honour then enquired from the jurymen whether they desired the ease to go on and, on being replied to in the negative, and a verdict of not guilty being returned, discharged accused.
