Hamilton, March 30

The Supreme Court to-day heard mi action in which Dynes Fulton, chairman of directors of the New Zealand Co-operative Dairy Company, claimed £IOOO damages against English and Luxford, for alleged breach of contract. Defendants counter-claimed for a like sum on a similar ground. The action arose out of a former action for alleged defamation by England and Luxford against Fulton, which was settled before coming to Court, a term of the settlement being that there should be no publication of the terms of the settlement other than the agreed upon statement. English and Luxford, it was alleged, caused to be published, however, a paragraph setting out the alleged terms, followed by a published denial and correction by Fulton. After hearing evidence to-day, His Honour Mr. Justice Ostler reserved bis decision.
