LYTTELTON ELECTION PETITION.

HEARING BEGUN YESTERDAY.

Christchurch, Last Night. The Lyttelton election petition hearing opened to-day before their Honours Judges Stringer and Ostler.

The Court was engaged all morning hearing evidence and argument, and adjourned to permit of examination of ballot papers. The hearing resumes to-morrow, when judgment will probably be given.

The petition by Mr. J. McCombs prays that the ballot papers be subjected to a further recount, and that petitioner be declared duly elected, inasmuch as the majority of valid votes were cast in his favour.

Mr Donnelly, for Mr. M. E. Lyons, said he had proposed to arrange for admissions from both Isides; but lie now understood the matter was one of proof. Mr. Justice Stringer said the circumstances in the Westland petition were different.

Mr. McCombs objected to the votes of 19 people on the ground that they were not residents of Lyttelton. He also claimed certain votes that had been disallowed because the voters made incorrect marks.

Respondent made similar claims.

After an adjournment it was annouonced that certain admissions and abandonments had been made by both sides. The result would be that nine witnesses would be called by petitioner and none by respondent.
