BALLOT PAPER IN POLLING BOOTH.

Christchurch, February 19. A ballot paper is the property of the voter until it is deposited in the ballot box. On this ground Messrs P. L. Davies and H. F. Herbert, J.P.’s dismissed in the Magistrate’s Court to-day a charge of fraudulently destroying a ballot paper at the last general election. Defendant was a widow. Evidence in the case was heard earlier in the week, when the Bench reserved decision until to-day. In dismissing the information, the Bench stated that the case had had the most careful consideration. The Bench had come to the conclusion that a ballot paper was the property of the voter until the time that it was deposited in the ballot box. On that ground it was the opinion of the Bench that the case should he dismissed. However, if the authorities deemed the case to be of such importance that they thought it should he tested by a Stipendiary Magistrate, the charge would he dismissed without prejudice to any further action.
