MOTOR SMASH SEQUEL.

Walter Turner Ltd., of Palmerston North, took action against A. E. Sexton, farmer, of Himatangi, at the Palmerston North Magistrate’s Court on Tuesday, claiming-the sum of £44 10/- for damage done to a motor ear belonging to the plaintiff Company, through alleged negligence ou the part of defendant. It was explained that defendant called upon the plaintiff Company for his car, which he had left at the garage for repairs. As it was not completed, however, defendant was lent another vehicle in which to reach his home at Himatangi. When proceeding home, (lie car crashed into the Rangiotu bridge, and was damaged, wherefore the plaintiff Company claimed on the damage caused through defendant’s negligence in driving. The defence was a refutal of liability. There was no question of the amount sued for, as it was admitted .that the damage was as extensive as claimed. It wats contended, however, that the ear was faulty when taken from the garage, and owing to this a wheel came off, resulting in the smash. Upon investigation of the car after the accident, defendant found that the axle had been eaten through with rust. After hearing the evidence, His worship gave judgment, for the plaintiff Company for the full amount with costs, £7 10/-.
