WTFF. SURRENDERED TO A MAORI. MAGISTRATE ORDERS HUSBAND TO PAY MAINTENANCE.

Auckland, 22nd August

"This is n most extraordinary ease," said Air Hunt. S.M., in deli voting reserved judgment in the Magistrate’s Court in respect to an application for a maintenance order made by Elizabeth Jane Dantes against her husband, William James Dix Barnes.

The Magistrate said that in August. l!)2n, an arrangement was made by which defendant surrendered his wife to a Maori. The Maori paid defendant £4OO and as the wife was agreeable, defendant left tile house. Some days later he returned and resumed cohabitation with his wife, and the Maori left. The parties then went to Wellington, where complainant subsequently gave birth to a half-caste child, which was taken by the Salvation Army. In October, 1022. I'omplainant left her husband and took possession of the child; in February, 1023. she obtained a maintenance order against the Maori, hut very little had been paid under it. Since complainant left her husband she has maintained herself and child, but is now in illhealth and is in receipt of charitable aid. The husband is willing to provde a home for complainant, on Ilia condition she did not keep the child; the woman, however, refused to pari with the child. “1 am of the opinion,” said Mr Hunt, "that the wife’s refusal is reasonable. The husband bartered her away to the Maori and connived at her adultery, and lie should not be cruel enough to separate her from the child, of whom she is so fond. Her health is bad, and she cannot perform household duties.” Defendant was ordered to pay maintenance at the rate of £1 u/- a week.
