JURY’S AWARD UPSET.
PICTURE THEATRE NOT RES - . PONSIBLE FOR ACCIDENT. (Christchurch, October 24. The verdict oil tlie jury awarding Robert Eagle £375 damages for injuries sustained by falling into a cellar in the Grand picture theatre was upset byJudge Sim to-day. The Judge said the defendants’ duty to protect the plaintiff did not extend to the whole theatre but only to the parts to which plaintiff might reasonably be expected to go in the belief that he was entitled or invited to go.. Plaintiff ought to have realised when he opened the door and found the room in darkness* that he laid no right to enter, instead he elected to go into the darkness and was not entitled to complain of any concealed danger he walked into at ids own peril. There was no evidence of negligence on the part of defendant. , Judgment was entered for defendant.
