VALIDATING A TRANSFER.

BOROUGH COUNCIL AND RACECOURSE TRUSTEES. At Monday night’s Borough Council meeting a letter was read from Mr J. Ivebbell, chairman of the Foxton Racecourse Trustees re the transfer of land from the borough to the trustees. The writer staled that he had interviewed the Minister for Lands and mentioned the exchange of land between the Foxton Borough Council and trustees and the sale of land by the Borough Council to the Racing dub. In the Minister’s reply he made no mention of the sale, but was investigating the matter. The letter continued: “I trust tlie Borough Council will support us in getting the title fixed up and will instruct their solicitor to furnish, such iiiformlion asked for or co-operate with the trustees solicitors. Tf a clause in the Washing-up Bill should he necessary we should press on with the information asked for.”

The following is a copy of the lot - ter forwarded by the Minister oi Lands to Mr Kebbell under date of January 16, 1923. —“\\ it It reference to your recent interview with me regarding the exchange ol land, between the Mnmiwatn Racecourse Trustees and the Foxton Borough Council, 1 have to advise you that from the information at present availahle, it' appears that the Borough Council desires to clleet an exchange with the Racecourse Trustees, but upon the documents being presented for registration, the District Land Registrar considered that the Borough Council could not deal with its properly in this way in view of the provisions of section .17 of I lie Public Reserves and Domains Act, 1908. 1 would suggest that the solicitors acting in the matter forward to the department full details of the proposal, to--gxl tiler ulli a ]>lan showiii”- (he location of the parcels of land affected in order that the proposals may he more closely examined. It might be necessary to consider the question of inserting a clause, in the Washing-Up Bill next session but that point could he decided after the solicitors have furnished the particulars referred to above."

It was decided to advise Mr KebItell that the Council agreed to the proposal to insert a clause in the “Washing Up Bill" to validate the sale of a piece of the target reserve to the Racecourse Trustees, provided same can he done -wit bout incurring any further legal expenditure, and that the member for the district, Mr J. Linldater, be asked to give the matter his attention.
