William Brown was charged with causing to be delivered for insertion in a newspaper an untrue advertisement relating to the, death of a woman. Defendant did not appear. The evidence showed that defendant had been living with a woman whose husband lived in Auckland. "When she died defendant instructed the undertaker to insert the death notice in the paper, giving her name as Brown. Defendant went to Auckland next day to inform the husband.

The Magistrate said defendant had apparently committed the offence in order (o protect the woman’s name. Her relatives had not been prejudiced by his action because he had gone to town to tell them of the death. However, it was essential that nothing untrue should be supplied in the nature of advertisements. Defendant was lined-£2 and costs. .
