“.JUSTICE CANNOT BE ADMINISTERED.” NEW TRIAL REFUSED. The jury failed to agree in the second trial of James Pajferson, on a charge of bookmaking, in the Wellington Supreme Court yesterday. Addressing the jury, his Honour, the Chief Justice, said: “I am sorry you have been unable to agree, because the facts of this case aud tho law of this cause are equally plain, and I cannot understand how: you are unable to agree. I hope it is not because you are in favour of gambling. It is necessary to agree upon a verdict iu New Zealand, and this emphasises the need for an amendment of the law'. In Scotland eight may bring in a verdict, and in France seven out of twelve, It is useless ordering a new trial. Some other form will have to be used with cases of this kind; it is useless wasting the time of the court. In Wellington justice cannot be administered if there is an infraction of the Gaming Act charged. .Who is to blame for that I don’t know. That is for the people to consider, and not for me.” Mr Macassey: There will be no order for a retrial? His Honour: No. Mr O’Leary: I take it the accused will be discharged. His Honour: Well, lie can go. There"is still . the charge against him. That is for the Crown to consider. i
