Kiach and McLennan, warehousemen, worn convicted of profiteering in connection wilh the sale of a kit-e-lien table.. Defendants were fined £IOO and costs. Mr Bartholomew. S.M., said the price nf the table slated to Mrs MeKarlano on her first visit was £2 ss; that cm her subsequent - visit she purchased it for £2 7s (id; that the factory cost to defendant company was 30s, less , 21 per cent, fur cash; that the maximum permissible trade profit was 33 per cent. Allowing 2s Cd for cartage, the extreme retail price would be £2 2s (id, and this was somewhat .•n excess of other traders’ prices. The table, therefore, was sold at a price which was unreasonably high. In considering tho question of penally, His ’Worship observed that a proper circumstance to take into consideration was ihe defence set up.
