PUBLICAN’S OBLIGATIONS
The question of whether proprietors of licensed houses are compelled to provide lodgings for persons seeking them was involved in an action brought by the Police against Alfred Gustofsen, licensee of the Britannia Hotel, at the Wellington Magistrate's Court on. Friday., on a charge of refusing to provide lodgings for Charles Joseph Simpmm. The complainant said that he went to the hotel on the evening of 2nd July, and asked for a bed without breakfast, as he intended to go to work at G o’clock on the followingmorning. The licensee's wile refused to hook him a room unless he paid for breakfast as well. The licensee had told him that, there'was nothing in letting a room without breakfast on account of laundry expenses. Air 0. Beere, for the defence, held that the complainant, whose home was at Lower Ilutt, was not a traveller, neither was he refused accommodation. Certain persons had made a practice of hooking a room, without breakfast, in order that they might be on the “privilege list” for liquor after G p.m., and the licensee had taken up that stand to protect himself. Air J. S. Evans, S.M., refused to dismiss the information on the points raised, and after hearing the evidence remarked that the man was entitled to get what he asked for in the way of accommodation, and a technical offence had been committed. However, the matter was not serious, and he would merely order the defendant to pay .the costs, £1 9s.
