ELECTION WAGER.
Stratford, Yesterday. At the Alagistrate’s Court, Geoi'ge Ivlorrison, blacksmith, claimed from Stanley. Sharp, hairdresser, £SO paid by Alorrisonto Sharp as the stakes in a wager on the result of the general election in Stratford. Alorrison claimed that Sharp paid over the money contrary to his instructions. Counsel for defendant contended that plaintiff was precluded from bringing an action by the last words of section 70 of tho Gaming Act, which sets- out that no action can he brought in respect of money “won, lost or staked” on any wagei’ing transaction. Counsel for plaintiff contended that the transaction between Morrison and Sharp was not a wagering transaction, hut only an ordinary contract between principal and agent. Counsel for plaintiff also held that the words quoted meant no more than was contained in section G 9, and that, therefore, the New Zealand Act was similar to the English Act, and that decisions under the English Act gave plaintiff the right to bring an action. Decision was reserved for a fortnight.
