The Municipal Corporations Act delines nuisances as follows: “Any land, building, erection, waler-elosd, earth-closet, privy, cesspool, urinal, ashpit, dustbin, or receptacle for dust, rubbish or refuse, or any natural stream, or any pool, ditch, gutter or wafercourse, or any sewer, culvert, or drain, or any accumulation or deposit situate or being within a borough or any offensive mallei' used as manure and placed on any land in a borough which is, or is in such a slate as to be or become a nuisance or injurious to health, shall be deemed a ‘nuisance’ within the meaning of this section.’’ The same Act gives the local authority power to cause to be disinfected any premises in which any infectious disease has occurred, also to disinfect or destroy any bedding, clothing, or other things exposed to infection, and do everything incidental thereto, and to abate nuisances. The Hospital and Charitable Institutions Amendment Act of 1910 provides that a hospital and charitable aid board “shall for the purpose of the Act of 190 S as it relates to the prevention of in-

lections disease, be deemed to be a local authority under that Act for the hospital district and all references in these provisions to a local authority shall accordingly be deemed to be references to a hospital and charitable aid board, and not to a local authority as defined by that Act.” The two Acts conflict and overlap. In our opinion I lie local governing bodies alone should lie re-> sponsible for the carrying out of matters connected with proper sanitation in their districts, and the removal of all things which arc a menace to the general health of the community, and lake oilier precautionary measures such as disinfecting, etc., and that Hospital Boards should concern themselves with iaderpiate institutions for administering to the sick. On the top of this conics the Public Health Act, which appears to overide and conflict with the other Acts mentioned. The law in this connection should he amended and made clear to all'concerned.
