CLAIM FOR £1,500 DAMAGES.
SEQUEL TO A. MOTOR FATALITY. Masierton, .March 2(J. A ea.-m of interest to the farming community and others was concluded in the Supreme Court this evening. It appears that some months ago a man named 11. R. Miller was riding on a motor-cycle on the Carterton road, and as he was passing a motor car a horse rushed out, through an open gale at the residence of Air John O’Dowd, and, it B alleged, knocked .Miller under the ear, causing fatal injuries. Airs Constance Miller, widow of the deceased, now claimed £1,500 damages from Air O’Dowd. for the defence it was alleged that the horse that was said to have knocked Aliller down was not in charge of Air O'Dowd at the time of the accident, but in charge of his sou. It was further alleged that undue negligence had not been shown on the pari of young O’Dowd. After a lengthy retirement, the jury failed to agree, and a fresh hearing wa,s ordered. Alenin while counsel for the defence will move for a nonsuit ’on certain points raised in the ease. '
