BREACH OF THE PEACE.
At the local S.M. Court yesterday morning, before Mr J. W. Poynton, S.M., Bert Hart and William Healey were charged by the police with creating a breach of the peace in a public place on December 30th. Healey pleaded guilty under provocation. There was no appearance of Hart. Constable Woods, in evidence, said on the night in question he saw a number of people assembled on the footpath near Whyte’s Hotel. Upon investigating, he saw both accused with their eoats off. Hart was on the ground unconscious, and Healey’s face bore evidence of the encounter.
Healey, in evidence, said Hart followed him and others into the hotel and called him by an insulting name. He invited him outside, and the fight was just about over when Constable Woods appeared on the scene.
The Magistrate said the affair might have had a more serious ending, but as both men appeared to have been knocked about they would be fined 10s each and.costs.
Healey asked for, and was granted, reasonable time to pay the fine.
