The agi'cemenl, dated August -Ist, Pvlo. entered into between the parties was produced. This provided that Ehrhorn should milk on shares for the defendant, from H() to 12b (rows and heifers under conditions and terms as set out in the various clauses of the agreement. 1 he term of (he agreement was for one year, with the provision that should Ehrhorn faithfully carry out all tmi conditions Chrystail was to renew the agreement for a further term, and at the end of that period a further renewal was to take place if the agreement laid been faithfully kept. On July Ist, Chrysla'l noli* lied Ehrhorn that the agreement wouid terminate at the end of, the lirst year, contending that Ehrhorn had committed breaches. Ehrhorn claimed that he had faithfully carried out all the conditions, and brought the present action for £SO damages against Chrystail for refusing to renew it. He also claimed £6(i for breaking in heifers which he said was verbally agreed to between them, but Avhieh Chrystail denied. Evidence for plaintiff was given

by F. W. Ehrhorn, Clara Ehrhorn, J. S. Duncan, 11. Case, and Henry Samos, and for the defence by John Chryslall, W. Seadden, A. E. Green and W. J. Rees, after which the case was adjourned to Palmerston North on Tuesday next, when legal argument will be heard.
