MAN A W ATT J COUNTY COUNCIL. PUBLIC notice is hereby given that the Manawatu County Council has made the following Bylaw which is now published for general information. HEAVY TRAFFIC BY-LAW. That m pursuance and exercise of the powers vested in it in that behalf by “The Counties Act, 1908,” “The Public Works Act, 1908,” and all other Acts and power whatsoever enabling the Manawatu County Council by way of Special Order hereby makes the following by-law : “Every person, whether residing in County or not, who shall conduct or who shall be about to conduct heavy traffic on any road in the County, on being requested so to do by notice under the hand of the Chairman, Overseer or County Clerk for the time being of the Council, delivered personally to such person, or posted through the ordinary course of post addressed to such person at his usual or last place of residence or business, shall forthwith give such security as shall be required by the Chairman on the certificate of a competent officer of the Council, that no special damage will accrue to any road, bridge, ferry or ford within the said County or under the jurisdiction of the said County Council by reason of such heavy traffic. Such security shall be by bond in such form as and with or without securities as the Clerk may require in a sum not exceeding £SOO, provided that should such person be dissatisfied with the amount of such security so required by the Chairman, the amount of such security shall be ascertained by an arbitration to be conducted according to the provision of "The Arbitration Act, 1908,” and in manner as if the same were a submission to arbitration under section 7 thereof, the cost of such arbitration to be paid by such person and by the Council in equal shares. Provided also that in lieu of a bond such person may deposit with the Clerk ot the County Council the sum required by the Chairman as aforesaid, or if the matter be referred to arbitration as herein provided, the amount ascertained by such arbitration. Persons not complying with the foregoing By-law * when requested are foruidden from engaging in such heavy traffic. Every person who shall do or cause to be done or oe concerned in doing anything contrary to the provisions of this by-law, or who shall omit to do anything required to be done by any such provision, shall be guilty of an offence against the By-law, and shall for each and such offence be liable to a penalty of not exceeding five pounds sterling, and where the offence is a continued one then to a penalty not exceeding five pounds for every day or part of a day during which such offence shall continue.”
This By-law shall come into force on the 18th day of April, 1913. The above By-law was made by Special Order at a special meeting of the Manawatu County Council held on the fourth day of February, IQI3, and confirmed at a subsequent meeting held on the first day of April, 1913The Common Seal of the Chairman, Councillors and Inhabitants of the County of Manawatu was affixed to the above By-law in the presence of JAMES G.
