APPEAL LODGED

An appeal against the judgment of Mr Justice Isaacs iu the Coal Vend case, delivered iu the High Court at the eud of last week, has been lodged 011 behalf of W. TAppleton, iu his capacity as managing director of the Huddart Parker Company. The appeal is lodged on the grounds (1) that the judgment is erroneous and that evidence was wrongly admitted ; (2) that there was no evidence of any joint intent by this defendant to do any of the alleged acts to the detriment ol the public ; (3) that the evidence fails to establish any intent to restrain or control the trade to the detriment of the public ; and v 4) that certain sections of the Act had been impliedly repealed by provisions of certain amending .vets.
The High Coiut convicted all uf the forty defendants in the case ot the several offences charged gainst them, and ordered each to ay a hue of ,£SOO, with the ex-.-ption of the Associated Northern
dolhery, because its individual members were amongst those dned. An injunction was granted restraining the defendants irom repetition or continuance of the several offences ol which they were convicted and the defendants were ordered to pay the plaintiffs’ costs. On the application of the colliery proprietors a slay of proceeding in connection with the penalities was granted pending an appeal. The lines imposed were the maximum allowed by law. They totalled ,£19,500.
