ARBITRATION COURT.

A FOXTON CAS!-:, ADELENE BERMANSEX v. \VM. ROSS & SOX, LTD. The Arbitration Court opened its Wellington sittings yesterday morning. Mr Justice Sim presided. In the Foxton compensation case, Adeleue Bermauseu (nee Carroll) v. Ross and Son., Etd., the Court was asked to decide whether marriage ended incapacity. Mr P. J O’Regan, representing Mrs Bermauseu, applied to commute the weekly payment into a lump sum. When the plaintiff was a single woman she met with an accident while in defendants'

employ losing her left arm. She was granted 5s per week on account of incapacity, and this payment continued until her marriage, when the defendants discontinued it. They were willing to commute and the courr was asked to fix the amount. He maintained that the marriage had not lessened the defendants’ liability. The President (Mr Justice Sim) : I suppose she has a husband who does keep her ? Mr Levi, representing the defendants, said he was not in a position to go on with the case, and knew nothing of the facts. Mr Justice Sim : Supposing, instead of getting married, she had succeeded to a legacy making her independent, you don’t suppose she would not have been entitled to the allowance ? Getting married does not remove her incapacity or give her a new arm. Mr Levi would not argue the interesting point, and the case will have to come up again during the present sittings.
