BEACH ROAD.

HARBOUR BOARD’S POSITION. At last night’s meeting of the Borough Council, an opinion was read from Mr T. F. Martin, the Municipal Association’s solicitor, in reference to the Harbour Board’s legal position in regard to contributing towards the cost of the proposed road to the Foxton beach. Mr Martin’s opinion is that the Harbour Board cannot legally agree to a contribution out of its revenue towards the forming and metalling of the road except as regards the part which goes through its endowments. For this part only the Board could legally contribute up to 50 per cent, of the cost of construction. No agreement, however, could be made by the Board towards the cost of maintaining same. If the Board joins in the construction of the road it will have to find the money out of its general revenues. His opinion, therefore, was that the Board may legally agree with the local authorities in whose jurisdiction the endowment is to contribute out of its revenue towards the cost of construction of that portion of the road only which goes through its endowment, but could not legally contribute anything towards the cost of maintenance.
