AN OBSCENE PICTURE.

Fkilding, October 22

Before A. D. Thomson, S.M., today, A, C. Morton, a local photographer, was called on to show why a certain photograph exhibited in his studio should not be destroyed as an obscene picture. It was an enlarged photograph of an eight months old boy dressed in pants which did not serve the proper purpose. Attached to the picture was a card emphasising the fact that the boy was only eight months old.

The Magistrate held that he should rely 011 his own opinion regarding the picture and not take evidence. His opinion was clear, and he decided that the picture was indecent, and had been light y seized by warrant. There was nothing indecent in a picture ot a young child sprawling on the floor in a natural position, but this picture was a very different matter. He ordered the picture to be destroyed. Defendant intimated that he would appeal.
