HARBOUR BILL.

TITDE —AN ACT TO CONSTD TUTK A HARBOUR BOARD FOR THU PORT OF FOXTON. Be it enacted by the General Assembly of New Zealand in Parliament assembled, and by the authority of the same as follows : Short title.—i. The short title of this Act is “ The Foxton Harbour Board Act, 1908.” Act to be a special Act. —2 This Act shall be deemed to be a special Act within the meaning of ‘ ‘ The Harbours Act, 1878,” which, with all Acts Amending the same, shall be incorporated with this Act. Interpretation.— 3. In this Act, if not inconsistent with the context; —‘ Board ’ means the Foxton Harbour Board as constituted under this Act: “ Harbour ” means the port and harbour of Foxton : “ The said Act ’’means “The Harbours Act, 1878,” with all Acts amending the same ; “ Harbour District ” means the Foxton Harbour District as constituted minder this Act Constitution of Board. —4. The Board shall consist of seven members, of whom lour shall form a quorum, and such members shall be appointed and elected as follows : (a) One member to be appointed by the Governor. (b) The Mayor of the borough of Foxton for the lime being. (c) One member to be appointed by the Manawatu County Council, and being a member of the said Council, One member to be appointed by the Palmerston North Borough Council, and being a member of the said Council. (e) One member to be appointed by the Feilding Borough Council, and being a member of the said Council. (f) One member to be appointed by the Devin Borough Council, and being a member of the said Council. ' (g) One member to be elected by the electors of the Harbour District. Elections. —5. The first election of the elective members shall be held on the second Monday in February, 1909, and the member then elected shall come into office on his election and shall hold office until the next biennial election of a member to be held as prescribed by the said Act. Mode of election.—6. (1). The Governor may, by Order in Council gazetted, appoint a Returning Officer and polling places for the purpose of the liist election of a member under this Act, and a day for such election, and may make such further provision for the same purpose as he shall deem necessary. . (2). The elective member of the Board shall be elected under the provisions of “The Docal Elections Act, 1904.” Offices. —7. The offices of the Board shall be within the Harbour District. Endowments. — 8 (a) The Board is hereby endowed with all wharfage, berthage, pilotage, and port dues in connection with the Foxton wharf and harbour, (b) All the foreshore on both banks of the Mauawatu River, commencing at the South Eastern corner of Whirokino No. 3,McGregor’s Bend, and extending thence to the mouth of the said river as far as high water mark. (c) Sections 268 and 270 containing Xl2 acres and 248 acres respectively being the Pilot Station Reserve. (d) All that piece or parcel of land situate in the township of Carnarvon in the Mauawatu District containing 418 acres more or less and being the section numbered 332 on the official plan of the said township and formerly known as the Omarupapaku Bush, but now designated the Signal Station Reserve bounded on or towards the north by Section 330 ; on or towards the East by a public road ; on or towards the South by Sections No. 475, 476, and 477, and on or towards the West by a public road dividing the same from section No. 329. Power to

lease. — 9 The Board may lease any lands vested in it, or any part thereof, at such rents and profits and upon such terms

and conditions as the Board shall determine, so that such leases be for any term not exceeding thirty - three years, to take effect from the date of the execution thereof. Harbour District. Harbour District shall comprise the Borough of Foxton. A copy of the above Bill and the plans of the lands affected thereby may be inspected at the Magistrate’s Court Office, Foxton, between the hours of 10 a.m. and 3 p.m. daily.
