FOXTOX, AUGUST \orn 1905. (Before Mr A. D. Thomson, S.M.) Judgment went for plaintiffs in the following civil cases; F. S. Easton v. Sydney Easton, claim £7 s Id, less £4 paid into court, costs £1 Gs; M. I’ecmn v. J, Sullivan, clain £2 18.-1 SJ, costs 10s, TIOKB V. EASTON. This was a case in which Thomas Robb (Mr Moore) sued F. S. Easton (Mr Harden) for £lB 10s for wages, Mr Mooro 'explained that since writing to defendant he had found some difference in the amounts apparently du r d , It was a question now whether the act of last session was retrospective and would cover receipts given in this case, which dated from 1902. F. S. Easton, defendant, produced books showing entries made by plaintiff himself, who kept them. In July, 1902, they had a sot'lament of accounts and Robb left his employment, Since then no demand had been made until recently. Witness owed Robb nothing now. Cross-examined by Mr Moore: All moneys due to Robb were paid to him or settled by contra. Witness had given plaintiff an account of the contra, and the latter was quite satisfied, Robb had not since requested any settlement until about three months ago, Thomas Robb, plaintiff, stated that ho bad put in a claim for six weeks wages up to May Gth, 1902, and had received one cheque. De Cendant wanted witness to sign the butt of the cheque as a recei.t in full payment. This ho would not do at first, but consequently signed it under protest Witness had never received anything' in the way of Contras as stated by E-ston. The reason witness had left the matter stand over for so long was that he had been unable to bring a care in the meantime. Cross-examination by Mr Harden was proceeding when the S.M. stopped it and gave judgment for defendant, with costs.
