A PECULIAR POSITION

A peculiar position was disclosed at the meeting of creditors in the estate of W. Wadey, held at Eltham on Monday. The liabilities in the estate of Wadey and Newlore amounted to over £6OO, but it appeared that until the 9th of September last Wadey was a minor and Newlove still is a minor, consequently the liabilities contracted prior to the 9th September are not recognised and Newlove cannot be declared bankrupt. The position is very delicate as if the Assignee sells the stock Newlove may demand his share of the stock. Newlove’s solicitor would not give an undertaking as to the position Newlove will take up as claimant, but agreed to the Assignee realising the stock. The creditors passed a resolution that a public examination be held.
