Malicious Prosecution.

Judge Cooper, awarded £IOO damages against Michael Freeman, a Mercury Bay storekeeper, for malicious prosecution. Three Austrian gumdiggers, during Freeman ’o absence, took gum to bis store to sell and on his return, a few days later, the sale was not effected. They took the gum away and sold it to another buyer. They, however, owed Freeman money, and he had them arrested for stealing gum. The case in tjba Magistrate’s Court fell through for want of evidence.
