A Bankruptcy Case.
» ♦ THE ESTATE OF JOE TOS, Before Mr W. R. Haselden, S.M., on Monday, at the instance of the Official Assignee, Leonard Montague Harris was charged " That he did on the 18th day of June, 1900, at Wellington, wilfully and with intent to defraud, make a statutory declaration for the purposes of the Bankruptcy Act, 1892, which was untrue in a material particular — to wit, the statement that one Joe Tos, a bankrupt, was at the time of his bankruptcy and then was justly and truly indebted to the firm of A. S. Paterson and Co. in the sum of £997 17s, whereas in truth and in fact the said Joe Tos was indebted to the said firm in a much less sum, the said Leonard Montague Harris knowing the said statutory declaration to ba untrue in the said material particular, being an indictable offence." The same defendant was further charged "That on the 28th June, 1900, at Wellington, he wilfully and with intent to defraud, did make a statement of accounts for the purposes of the Bankruptcy Act, 1892, being a statement of accounts between one Joe Tos and the firm of A. S. Paterson and Co., which was untrue in certain material particulars, the said Leonard Montague Harris knowing the said statement of accounts to be untrue in the said material particulars, which were as follows :— Omitting to credit £62 8a 4d (for flax) and £17 19s 6d (re Osborne) ; crediting £118 6a 7d (re Levin and Co.) instead of £120 28 3d ; charging £328 2s (' cheque pay wages'); £15' 16s 8d (Bell, Gully and Bell) ; £15 (law expenses re Allen) ; £126 (loss through default in carrying out hemp contract) ; and overcharging interest, being on indictable offence." Mr Gray appeared for the prosecution and Mr Skerrett and Dr Findlay for the defence. Joe Tos and the Official Assignee were examined and the case was adjourned to the fol owing day.
